Terms And Conditions

Terms & Conditions

Last updated: 25 October 2026

1. About these terms

These Terms & Conditions apply to your use of the Symperical Small Business Consulting website at https://symperical.com.au, including its general content, articles, resources and introductory assessments.

In these terms, “Symperical”, “we”, “us” and “our” refer to Symperical Small Business Consulting. The legal entity or person operating Symperical will be identified in the relevant business and client documents once confirmed.

By using our website, you agree to these terms, subject to applicable law.

2. Website information

We aim to provide useful and relevant information. Website content is provided for general information and educational purposes.

We do not warrant that all website content will always be complete, current or suitable for your particular circumstances. You are responsible for assessing information before relying on it.

3. Free Business Health Check

The free Business Health Check is an introductory assessment based on information you provide and Symperical’s four-pillar framework.

Any scores, categories, observations or recommendations are indicative only. They are not a comprehensive audit, independent verification of your information or a guarantee of business performance.

The report may identify some areas for consideration while missing other issues. A particular score does not, by itself, establish whether a business is successful, profitable or free from risk.

The assessment may use automated scoring and AI-assisted report generation. Outputs may contain errors or lack context.

You should consider the relevance of any recommendation to your circumstances and seek appropriate professional advice before making significant decisions.

4. No guarantee of business results

Symperical aims to help business owners gain clarity, identify opportunities and take practical steps towards their goals.

We cannot guarantee increases in revenue, profitability, business growth or any other particular outcome. Results depend on individual circumstances, market conditions, decisions, available resources and implementation.

5. Paid consulting services

Paid consulting services will be governed by a separate proposal, client service agreement or other written terms supplied before you commit.

The relevant agreement should explain the services and deliverables, fees and payment schedule, contract term, client responsibilities, cancellation and termination arrangements, intellectual property rights and other relevant conditions.

The website terms do not themselves establish the full conditions of any paid consulting package.

If there is an inconsistency between these website terms and a signed client service agreement, the client agreement will govern the relevant engagement to the extent permitted by law.

Nothing in these terms excludes or restricts rights or guarantees that cannot lawfully be excluded or restricted.

6. Intellectual property

Unless otherwise stated, the content on this website—including text, branding, graphics, downloadable resources, assessment materials and report frameworks—is owned by or licensed to Symperical.

You may use our materials for your own personal or internal business purposes, subject to any specific terms supplied with the material.

You must not reproduce, republish, distribute, sell or commercially exploit our content without prior written permission, except where permitted by law.

Access to our materials does not transfer ownership of intellectual property to you.

7. Information you provide

You are responsible for ensuring that information you submit is accurate to the best of your knowledge and that you are authorised to provide it.

Do not submit confidential information about another person or business unless you have the right to do so.

You must not use our website to submit unlawful material, interfere with its operation, attempt unauthorised access or misuse our assessment tools.

Our collection and handling of personal information is described in our Privacy Policy.

8. Third-party services

Our website and services may use third-party platforms for forms, hosting, payments, communications, reporting or other functions.

Third-party services may have their own terms, privacy policies and availability conditions. We do not control the independent operation of those services. Nothing in this clause excludes responsibility that applicable law requires us to retain.

9. Website availability

We aim to keep our website available and functioning, but cannot guarantee uninterrupted access or error-free operation.

We may update, suspend or discontinue website features where reasonably necessary for maintenance, security or operational reasons.

10. Liability and statutory rights

To the extent permitted by law, we are not responsible for loss arising from treating general website information or introductory assessment results as a substitute for advice tailored to your circumstances.

Nothing in these terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot lawfully be excluded, restricted or modified.

Any lawful limitation of liability must be interpreted subject to those rights.

11. Changes to these terms

We may update these terms from time to time. The current version will be published on our website with its updated date.

Changes to these website terms do not automatically vary a separate signed client service agreement.

12. Governing law

These terms are intended to be governed by the applicable laws of Western Australia and the Commonwealth of Australia, subject to any mandatory legal protections and the jurisdiction of the relevant courts or tribunals.
